Starting dialysis at an advanced age is a clinical challenge and an ethical dilemma. The advantages of starting dialysis at “extreme” ages are questionable as high dialysis-related morbidity induces a reflection on the cost- benefit ratio of this demanding and expensive treatment in a person that has a short life expectancy. Where clinical advantages are doubtful, ethical analysis can help us reach decisions and find adapted solutions. Mr. H is a ninety-year-old patient with end-stage kidney disease that is no longer (...) manageable with conservative care, in spite of optimal nutritional management, good blood pressure control and strict clinical and metabolic evaluations; dialysis is the next step, but its morbidity is challenging. The case is analysed according to principlism (beneficence, non-maleficence, justice and respect for autonomy). In the setting of care, dialysis is available without restriction; therefore the principle of justice only partially applied, in the absence of restraints on health-care expenditure. The final decision on whether or not to start dialysis rested with Mr. H (respect for autonomy). However, his choice depended on the balance between beneficence and non-maleficence. The advantages of dialysis in restoring metabolic equilibrium were clear, and the expected negative effects of dialysis were therefore decisive. Mr. H has a contraindication to peritoneal dialysis (severe arthritis impairing self-performance) and felt performing it with nursing help would be intrusive. Post dialysis fatigue, poor tolerance, hypotension and intrusiveness in daily life of haemodialysis patients are closely linked to the classic thrice-weekly, four-hour schedule. A personalized incremental dialysis approach, starting with one session per week, adapting the timing to the patient’s daily life, can limit side effects and “dialysis shock”. An individualized approach to complex decisions such as dialysis start can alter the delicate benefit/side-effect balance, ultimately affecting the patient’s choice, and points to a narrative, tailor-made approach as an alternative to therapeutic nihilism, in very old and fragile patients. The paper contends that transcendental phenomenology is a form of radical immanent critique able to explicate the necessary structures of meaning-constitution as well as evaluate our present situation through the historically traditionalized layers of concrete, lived experience. In order to make this case, the paper examines the critical dimension of phenomenology through the lens of one of its core conditions for possibility: the imagination. Building on—yet also departing from—Husserl’s own analyses, the paper contends that the imagination is both self- and (...) lifeworld-constituting. The imagination is anchored in our everyday senses of self and world as well as able to distance itself from being naively moored in normalized and deeply sedimented commitments. It is precisely this ‘anchored distance,’ rather than a sweeping doxic and ontic neutrality and negative freedom, that reveals the critical dimension of the imagination. (shrink)

Machiavelli analiza (...) la ciudad como un campo de deseos en pugna, el deseo del pueblo de no ser oprimido y el de los nobles de ambición ilimitada. En el análisis que despliega el autor sobre estos deseos en conflicto, pero sobre todo en la relación entre el príncipe, los nobles y el pueblo, así como en la caracterización que realiza de éste, es posible hallar elementos en ciernes de la psicología de las masas desarrollos luego por el psicoanálisis freudiano. The study of signed languages has inspired scientific' speculation regarding foundations of human language. Relationships between the acquisition of sign language in apes and man are discounted on logical grounds. Evidence from the differential hreakdown of sign language and manual pantomime places limits on the degree of overlap between language and nonlanguage motor systems. Evidence from functional magnetic resonance imaging reveals neural areas of convergence and divergence underlying signed and spoken languages.

This paper discusses the relation between the human security paradigm and the cosmopolitan democracy scenario as models for humanizing and changing the current international system and transforming it in a global security and development system centered on the individual rather than on the nation state. The main idea for which I argue is that the human security paradigm and the changes it determined in international relations (especially through the responsibility to protect principle) are compatible with the cosmopolitan democracy scenario for (...) changing and transforming the current international system. Drawing on Husserlian resources and existentialist and hermeneutical approaches, this book argues that critique is largely a question of method. It shows that phenomenological discussions of social and political problems draw from a tradition of radically critical investigations in epistemology, social ontology, political theory, and ethics.

Intimate partners are an important source of support when pursuing health goals. A vast amount of literature documents the role of social support in alleviating recipients’ distress and facilitating health behaviors. Less studied is the phenomenon that providing support may entail a benefit for the provider, particularly in the context of health behavior change. In the present study, we investigated whether providing social support in daily life would be associated with more health behavior, and emotional and relational well-being that same (...) day, using a sample of romantic couples aiming to become more physically active. Ninety-nine inactive and overweight heterosexual romantic couples (=198 individuals) participated in this dyadic daily diary study. Both partners reported on the provision of social support, positive and negative affect, and relationship satisfaction in electronic end-of-day diaries across 14 consecutive days. Moderate-to-vigorous physical activity (MVPA) was objectively assessed via triaxial accelerometers (Actigraph GT3X+). Using the Actor-Partner Interdependence Model (APIM), dyadic data analyses indicated that providing support to the partner was associated with higher own MVPA, more own positive affect, less own negative affect, and more own relationship satisfaction (actor effects), over and above the effect of support provision on outcomes in the other partner (partner effects). The present findings suggest that the provision of daily social support in couples is strongly associated with enhanced well-being not only at a personal level but also at a relational level. Providing social support may also serve the function of relationship maintenance. Thus, shifting the focus away from the recipient to examine beneficial effects of social support in providers is highly relevant. Future research should address the question of when, why, and how giving support is beneficial. (shrink)

The main goal of this paper is to explain the link between the algebraic and the Kripke-style models for certain classes of propositional logics. We start by presenting a Priestley-type duality for distributive lattices endowed with a general class of well-behaved operators. We then show that finitely-generated varieties of distributive lattices with operators are closed under canonical embedding algebras. The results are used in the second part of the paper to construct topological and non-topological Kripke-style models for logics that are (...) sound and complete with respect to varieties of distributive lattices with operators in the above-mentioned classes. This paper investigates how the distribution of negative polarity items can inform our understanding of the underlying semantic representation of constituent questions. It argues that the distribution of NPIs in questions is governed by the same logical properties that govern their distribution in declarative constructions. Building on an observation due to Guerzoni and Sharvit that strength of exhaustivity in questions correlates with the acceptability of NPIs, I propose a revision of the semantics of questions that can explain this link in (...) terms already familiar from the literature of negative polarity, namely the availability of a local downward entailing environment. I argue for a new theory of questions that takes strength of exhaustivity to be encoded internal to the question nucleus rather than in different answer-hood operators. This switch, while conceptually a simple move, has far-reaching consequences in the domain of questions. I also show how this new analysis can account for a host of issues related to NPIs, such as the subject–object asymmetry noted by Han and Siegel, the interaction between NPIs and high versus low wh-adjuncts, the varying acceptability of NPIs in the restrictor of which-phrases, and the contrast between weak and strong NPIs. Many have deemed ineluctable the tension between Husserl’s transcendental eidetics and his Crisis method of historical reflection. In this paper, I argue that this tension is an apparent one. I contend that dissolving this tension and showing not only the possibility, but also the necessity of the successful collaboration between these two apparently irreconcilable methods guarantees the very freedom of inquiry Husserl so emphatically stressed. To make this case, I draw from Husserl’s synthetic analyses of type and concept constitution as (...) well as his later work on sedimentation and streaming-in and develop a richer modal taxonomy than the one Husserl proposed. I employ this taxonomy in an examination of the structures and conditions for the possibility of transcendental eidetic variation in order to show this method’s reliance on historically sedimented epistemic and normative resources. This reliance brings to light the necessity for a methodological critique, which is precisely what I take to be the work of teleological–historical reflection as Husserl comes to conceive it in the Crisis. In this paper, close attention is paid to the argumentative patterns resulting from combining pragmatic argumentation in which a recommendation is made with arguments in which the majority is invoked. I focus on such argumentative patterns as employed by European parliamentary committees of inquiry conducting inquiries into the activity of the Equitable Life Assurance Society. By incorporating legal and political insights about the activity of these parliamentary committees of inquiry into a pragma-dialectical argumentative approach, an analysis will be given of (...) the selected argumentative pattern. This analysis will reveal which standpoints are supported by which arguments and how these arguments relate to each other to increase the acceptability of the recommendation made. In addition, the analysis will explain the arguer’s argumentative choices in the pattern employed. (shrink)

We advocate a broader taxonomic focus in the field of behavioral innovation, as well as the use of comparative field research, and discuss the unique conservation implications of animal innovations and traditions.

Husserl’s extensive analyses of image consciousness (Bildbewusstsein) and of the imagination (Phantasie) offer insightful and detailed structural explications. However, despite this careful work, Husserl’s discussions fail to overcome the need to rely on a most problematic concept: mental images. The epistemological conundrums triggered by the conceptual framework of mental images are well known—we have only to remember the questions regarding knowledge acquisition that plagued British empiricism. Beyond these problems, however, a plethora of important questions arise from claiming that mental images (...) are structural moments of imaging and imagining. Any attempt to clarify the structure and conditions for the possibility of aesthetic experience must first provide an unambiguous account of pictorial depiction—a task unattainable through the mental images discourse. Similarly, exposing the import of the imagination for theoretical scientific inquiries (be they positive or eidetic) requires an initial explication of the structure of this consciousness; this explication, however, must address our ability to imagine non-spatially determined objects—something the conceptual framework of mental images utterly fails to accomplish. In this paper I argue against Husserl’s reliance on mental images in his phenomenological analyses of imaging and imagining and propose an alternative structural account for both. This account is free of this reliance and able to steer clear of its insidious implications for epistemology, aesthetics, and methodological reflections. By closely following the development of Husserl’s account I suggest alternative descriptions while building on Husserl’s important work. (shrink)

Prior researches have highlighted challenges and variations arising from the requirements of research ethics committees and ethics governance systems across diverse research fields. This emphasizes the need to investigate how universities convey and implement research ethical practices. Research ethics plays a pivotal role in guiding the integration of ethical principles throughout all stages of research starting from its inception and planning to its completion and the dissemination of results. These practices encompass a range of considerations, reviews, guidelines, and processes aimed (...) at safeguarding the rights, dignity, health, safety, and privacy of research participants. Using the content analysis technique, this paper aims to analyse research ethical practices information on universities’ websites from three developed countries and developing countries respectively using the isomorphism conception. The findings suggest that the coercive, normative, and mimetic isomorphic pressures explain the research ethics governance practices. The ethical practices information was disclosed more on university websites of the developed countries. Suggestions to improve the university’s research ethics governance system for the post-COVID-19 era were provided in the paper. (shrink)

In this paper, the author examines the use of pragmatic argumentation in European practices of political accountability in which the politicians explain and justify a future course of action which they plan to undertake in order to solve an existing problem. The author explains some vital institutional characteristics of the practices under discussion and demonstrates how these institutional characteristics constrain the use of pragmatic argumentation. In addition, the author shows which criteria arguers commonly invoke in practices of political accountability to (...) make their pragmatic arguments acceptable to critics. (shrink)

The main goal of this paper is to explain the link between the algebraic models and the Kripke-style models for certain classes of propositional non-classical logics. We consider logics that are sound and complete with respect to varieties of distributive lattices with certain classes of well-behaved operators for which a Priestley-style duality holds, and present a way of constructing topological and non-topological Kripke-style models for these types of logics. Moreover, we show that, under certain additional assumptions on the variety of (...) the algerabic models of the given logics, soundness and completeness with respect to these classes of Kripke-style models follows by using entirely algebraical arguments from the soundness and completeness of the logic with respect to its algebraic models. The European Union is making increased efforts to find simpler and more effective ways to function adequately in the eyes of its citizens by using ‘soft law’ instruments such as recommendations. Although they have no legally binding force, recommendations have practical and legal effects occurring partly due to their normative content in which a course of action is prescribed and further supported by arguments intended to persuade the addressees of a political position. Although recommendations function as persuasive instruments due to (...) their argumentation, the characteristics of argumentation and how it is employed to convince the addressee to comply with certain measures have not been investigated at all. The main goal of the paper is to explain how arguments are used by the European Commission when recommending Member States to follow a new course of action. First, we will unravel the justificatory reasons employed by the Commission in order to make Member States comply with new measures and we will show how these reasons are combined into an argumentative pattern : 1–23, 2016; J Argum Context 6: 3–26, 2017). This pattern basically prescribes a course of action to Member States, which is further supported by arguments in which the necessity and advantages of following the proposed course of action are justified. Second, we will explain how and why the way in which the arguments are combined in this complex pattern could be potentially persuasive for the Member States despite the legally non-binding character of recommendations. We will show that the European Commission tries to persuade the Member States to take new measures by evading the burden of proof imposed by the legislative framework. At a more specific level of analysis, we will delve into the implicit premises in the argumentation, which enable us to identify cases of evasion of the burden of proof due to the Commission’s use of implicit starting points which might not be accepted by the Member States. Moral emotions (i.e. guilt, shame) and interpersonal processes such as fairness have been theorised to facilitate cooperation within society. However, empirical tests to support this association have yielded inconsistent results. The present research investigated whether guilt and shame have an impact on fairness-related decision-making and reciprocity-driven cooperation. College students (N = 94) were assigned to one of three experimental conditions (Guilt vs. Shame vs. Control) and instructed to complete an iterated Ultimatum Game against two anonymous partners. We manipulated social context (...) so that one partner would appear as predominantly fair, and the other as predominantly unfair. For guilt, we found that participants (assigned as proposers) reciprocated fair partners with significantly larger amounts of money (i.e. positive reciprocity). For shame, we found that participants had higher rejection rates of unfair splits, and subsequently offered less money to unfair partners (i.e. negative reciprocity). We argue that both guilt and shame benefit fairness-related judgments, guilt by endorsing fairness, and shame by punishing unfairness. Our results also show that guilt and shame benefit reciprocity-driven cooperation, although they do so via different pathways. Our findings suggest that guilt promotes cooperation via positive reciprocity, whereas shame stabilises cooperation via negative reciprocity. (shrink)

Patients who have an oncological disease and are in palliative care belong to a group that is often characterized as highly vulnerable, and their participation in clinical trials poses a number of ethical problems. This study is cross-sectional and analytic. In all, 82% of those who took part consider it ethical to conduct research with patients in palliative care, either to help other patients in the future, in the hope of gaining some improvement or due to confidence in the physician-researcher. (...) The wide acceptance to participate in these research studies shows the potential benefits appear to exceed the merely therapeutic ones. Altruism, hoping to improve or the perception of continuing to "fight" the disease are aspects to bear in mind when evaluating respect for the autonomy of the persons involved. (shrink)

This study examined the relationship between the perceived fairness of the assessment process and the intention of participants to appeal the process, while taking into consideration the influence of two personality traits. Specifically, two of the Big Five traits, neuroticism and agreeableness, were included in the model, based on their special importance in predicting “anger-like” reactions similar to that triggered by unfairness. This study builds on the theoretical integration of the two dominant frameworks of organizational justice, and on two separate (...) empirical studies that use different methodologies : a personnel selection simulation and a study of an academic examination process. The pattern of results was similar in both studies. Neuroticism was not detected as a moderator based on the significance of the interaction term, but conditional effect analysis identified the specific area of scores where neuroticism was found to have a buffer effect on intention to appeal. Agreeableness weakens the relationship between perceived fairness and intention to appeal. However, contrary to our expectation, high agreeableness does not decrease but rather increases the probability of appealing the assessment process when it is perceived as unfair, thus providing evidence for the Pollyanna myth, i.e., that highly agreeable individuals are more likely to react to and appeal unfairness. This introduction presents three articles that remember the life and work of Antonio Millán-Puelles. It contains a summary of the seminar which took place in the University of Navarra in January 2005 as a tribute to Millán-Puelles. It also registers the articles from Millán-Puelles Publisher in Anuario Filosófico, as well as the articles griten by other authors on Millán-Puelles’ work.

The present article dwells on the idea of the empowerment of women as it was used by the Communist regime. Eugenics, a field much discussed in inter-war Romania, was the main tool in controlling women. The principles of this science, related to the idea of biology as destiny, were adopted and applied so that the private sphere became public. My thesis is that even if these principles were used in the communist strategy in order to strengthen the nation, in fact, (...) their core aspect – reproduction – became only a means for increasing work force and in the end weakened the family and implicitly the nation. Wie werden unsere Wahrnehmungs- und Affektmuster, unsere Körpererfahrungen, unser Denken und unsere Reflexionsmöglichkeit geformt? Corina Färber entwickelt eine integrierte Subjektivierungsanalytik im Anschluss an Louis Althusser, Michel Foucault und Judith Butler. Dies erlaubt ihr, die Subjektwerdung als ambivalenten und konkreten Prozess analysierbar zu machen und im Hinblick auf die Möglichkeiten der politischen Handlungsfähigkeit und politischen Subjektivierung zu befragen.

In this paper, the author examines the burden of proof in the argu- mentative confrontations taking part in practices of political accountability. She does so by explaining how politicians maneuver strategically with the burden of proof in an attempt at winning the discussion in which they are involved. After making clear the role of the burden of proof in defining the difference of opinion in argumentative confrontations, the author outlines the constraints imposed by practices of political accountability on the burden (...) of proof. Finally, she analyzes in detail a concrete case in which a politician maneuvers in such a way that his burden of proof is significantly diminished. (shrink)

As Larry Laudan pointed out in the 1970s, in a convincing attempt to revive Auguste Comte’s positive philosophy, one overlooked aspect of Comte’s nineteenth-century philosophy of science was his categorical rejection of causal notions and their explanatory role in physical science. For example, Comte was skeptical about Laplace’s interpretation of Newtonian mechanics and the expansion of Laplace’s model of particles and forces to electricity, magnetism, and heat. But Laudan himself was not very clear on how Comte’s overall skepticism about causation (...) was modern rather than, say, naive. Much earlier, John Stuart Mill made the case that Comte was in fact confused about the notion of cause, which impeded Comte from distinguishing between “metaphysical” and “physical” causes and which stemmed from a narrow and uncritical attachment to Comte’s antimetaphysical program. This article is an attempt to argue against Mill that Comte was not naive: he envisioned a construction of physical theories that did not need to rely on causal notions. By stressing this point, I hope to make more transparent the sense in which Comte’s rejection of causation in physical science had a “modern ring about it.”. (shrink)

In 1992, the much acclaimed prolific American writer Joyce Carol Oates publishes Black Water – a very harsh and condensed literary reenactment of a gruesome event having taken place more than twenty years before and known as the “Chappaquiddick incident”. Another twenty years later, through her 2012 novel Mudwoman, the author seems to revisit the topic that had haunted her for decades. This paper aims at establishing a certain narrative pattern connecting the two novels not only thematically, but also phantasmatically: (...) the sudden “resurrection” of Joyce Carol Oates’s character in the 2012 novel is, as we see it, far from being “incidental”. By “textual anastomosis”, we understand a subjective association of narratives in order to show how the disembodied consciousness “travels” from one character’s fictional body to another’s, triggering a whole bunch of personal memories which also resurrect in this other character’s fictional biography.
